The General Contracting Conditions regulate the distance selling relationship between AUKA ATELIER SL and the user or client, in accordance with legal stipulations, especially Law 7/1998, of April 13, on General Contracting Conditions, Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users, Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, General Data Protection Regulation (EU) 2016/679, Law 7/1996, of January 15, on Retail Trade Regulation, and Law 34/2002 of July 11, on Information Society Services and Electronic Commerce.
AUKA ATELIER SL reserves the right to make modifications it deems appropriate, without prior notice, to the General Conditions. These modifications may be made, through its websites, in any manner admissible by law and shall be binding during the time they are published on the website and until they are validly modified by subsequent ones. However, AUKA ATELIER SL reserves the right to apply, in certain cases, Special Contracting Conditions with preference to these General Conditions when it deems it appropriate, announcing them in a timely and appropriate manner. The changes referred to in this section will not affect contracts concluded prior to the publication date of such changes.

The duration of the contract will be linked to the delivery of the product without prejudice to the right of withdrawal.

Upon receiving the product at the delivery address provided, the customer will receive an invoice or copy of the order. The user will be offered the option of having an electronic invoice with prior consent. Acceptance of this billing method will imply the sending of the invoice electronically, with this having the appropriate legal effects. Subsequent invoices will be provided by this means unless otherwise indicated. The consent given to receive electronic invoices may be revoked at any time by sending an email to the email address indicated for this purpose, above.
Offer and validity

However, AUKA ATELIER SL reserves the right to withdraw, replace, or change the products offered through its website by simply changing the content thereof. The products offered on our online store include a photograph and their essential characteristics, this being the information obtained from the manufacturer. The available colors of the product are identified in the product characteristics.
Warranties
AUKA ATELIER SL is responsible for any lack of conformity in all products offered on the website for a period of three years from delivery.
In accordance with the General Law for the Defense of Consumers and Users, defects appearing during the first 2 years in new products are considered to be of origin, that is, they already existed at the time of delivery, unless the company can demonstrate that the defect was caused by misuse.
AUKA ATELIER SL has a after-sales service, during the indicated period. The customer may go to the AUKA ATELIER SL establishment, to the after-sales service, by email to administracion@auka.es or to the points established by the supplier itself. When it comes to perishable products and they are received in poor condition or expired, please contact via administracion@auka.es. It will be essential to follow the conservation instructions determined on the packaging, as well as to observe the expiration date, keeping the purchase receipt in any case.

All products indicate the sale price in euros and include Value Added Tax (VAT).
If any other tax is applicable, it will be indicated (IGIC or IPSI).

Payment methods

If the amount of a purchase has been fraudulently or improperly charged using the number of a payment card, its holder may demand the immediate cancellation of the charge. In such a case, the corresponding debit and credit notes in the accounts of the supplier and the holder will be made as soon as possible.
However, if the purchase had indeed been made by the cardholder and the demand for refund was not the result of exercising the right of withdrawal or termination and, therefore, had unjustly demanded the cancellation of the corresponding charge, the cardholder will be obligated to compensate AUKA ATELIER SL for the damages and losses caused as a result of said cancellation.

Order execution
AUKA ATELIER SL undertakes to deliver the order within the following period: 48 hours.
The availability of products offered by AUKA ATELIER SL may vary depending on customer demand. Although AUKA ATELIER SL periodically updates the stock, the product requested by the customer may be out of stock at that time.
In case of non-execution due to unavailability, AUKA ATELIER SL will proceed as follows: The customer will be notified of the lack of stock of the product and the order will be automatically canceled, with a full refund of the amount.
Right of withdrawal
The buyer will have a period of fourteen calendar days to withdraw, from the day the customer receives the product, without any penalty and without indicating the reasons.
The customer must return the products subject to withdrawal without undue delay and in any case no later than within 14 calendar days from the date on which their decision to withdraw from the contract is communicated.
The refund corresponding to the withdrawal will be made within 14 calendar days from the date on which the decision to withdraw from the contract is effectively and unequivocally communicated, provided that the goods or products subject to withdrawal have been received beforehand, otherwise, the refund may be withheld until the goods are received or until the Customer provides proof of their return.
The user is informed that they will only be responsible for the decrease in the value of the goods resulting from handling other than that necessary to establish their nature, characteristics, or operation.
The exercise of the right of withdrawal must be carried out by notification through a telephone call to 934141609, by sending an email to administracion@auka.es, by sending a written notice to our postal address MUNTANER 430 ENTLO, 08006 BARCELONA (BARCELONA), or through the withdrawal form.
As established in article 103 of Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users, supplies of services or goods made to the consumer's specifications or clearly personalized, or that, by their nature, cannot be returned or may deteriorate or expire quickly, are exempt from withdrawal. Being the product one of the following exceptions:

The supply of sealed goods that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery.
The supply of goods that, after delivery and taking into account their nature, have been inseparably mixed with other goods.
Return
The customer must return or deliver the product directly to AUKA ATELIER SL, at the address MUNTANER 430 ENTLO, 08006 BARCELONA (BARCELONA), without undue delay, and in any case within a maximum period of fourteen calendar days from the date the right of withdrawal from the contract is formalized. The deadline will be considered fulfilled if the customer returns the product before the end of the period.
The customer will bear the return costs of the product.
Refund of payment
The refund of the amounts paid by the customer will be made using the same payment methods used by them, provided that no other arrangements have been made.
AUKA ATELIER SL will refund the amounts paid by the customer within 14 natural days from the date of receipt of the withdrawal right.
Return of defective product
In the event that the product is not in good condition and the causes attributable to this are not the customer's fault, the customer will have the right to return the product, informing AUKA ATELIER SL of the reason for the return through any of the means provided in these contracting conditions, and at no cost to the customer. This return due to a defect or poor condition of the product will not be considered a right of withdrawal.
AUKA ATELIER SL undertakes to bear the cost of the return and to replace the product with a new one in accordance with the conditions accepted at the time of sale.
Claim

Jurisdiction
Similarly, AUKA ATELIER SL reserves the right to bring civil or criminal actions it deems appropriate for the misuse of its website and content or for non-compliance with these conditions.
The relationship between the user and the provider will be governed by the current regulations and applicable in the Spanish territory. Should any dispute arise, the parties may submit their conflicts to arbitration or resort to ordinary jurisdiction complying with the rules on jurisdiction and competence in this regard.
